MINUTES FOR SELECT BOARD MEETING & PUBLIC HEARING

Wednesday, July 19, 2023 - 7:00PM at the Hollis Community Building

Attendees: Select Board Members - David McCubrey, John Rogala, Mary Hoffman; Select Board Office Asst. Bennet Flinner; Camera Operator Ken Knudsen; Hollis Freewheelers ATV Club President Adam Roy; Waterboro ATV Club President Todd Abbott; Public Comment: Terry Walters, Michael Faucher, Dan Yarumian, Todd Hurtubise, Ed Dyson, Barbara Coleman, Steve Stonash, Rick Alderette, Tim Cross.

1.   Meeting called to order by McCubrey at 7PM.

2.   On the motion of Hoffman and Rogala, the Select Board suspended the Select Board meeting and opened Public Hearing regarding Hollis Freewheelers ATV Club proposed road & trail access on Deerwander, Plains & Saco Roads and ATV trail parking. Passed 3-0.

Public questions and concerns included:

  • What is current ATV access in Waterboro?
  • Who is liable for accidents with vehicles, especially young ATV riders ages 10-16? 
  • Who pays and implements signage for trail access?
  • Are ATV owners required to be insured?
  • How many ATV owners in Hollis that use these trails are insured? 
  • What is the dispute resolution method for issues since we have no law enforcement? 
  • Hollis ATV club claims to be non-profit but not registered as a 503-b.
  • ATVs have used a Poland Spring trail in Hollis illegally for 5 years due to no enforcement of laws.
  • Concerns about noise.
  • How many riders per day are using Hollis trails currently? 
  • Encouraged the ATV club to keep asking property owners for access to trails instead of using public roads, as there are too many speeders and drivers that don't respect the traffic laws. 

3.   On the motion of McCubrey and Rogala, the Select Board closed the Public Hearing and reconvened Select Board Meeting. Passed 3-0.

4.   Old Business – Meeting minutes from June 7, 2023 (all present) and June 21, 2023 (Rogala absent) - On the motion of Hoffman and McCubrey the board approved minutes from June 7, 2023 - Passed 3-0. On the motion of Hoffman and McCubrey, the board approved minutes from June 21, 2023 - Passed 2-0-1 (Rogala absent).

5.   New Business          

               a.  Appointments – Duane Hanson – Code Enforcement Officer, Plumbing Inspector, Building Inspector, Electrical Inspector. On the motion of Hoffman and Rogala, the Select Board appointed Duane Hanson for all the above positions. Passed 3-0.

               b.  Policy Updates - Rescind Policies #4 (Circulation of Petitions – now an ordinance) and #20 (Hollis FD Training Facility). On the motion of Hoffman and Rogala, the Select Board rescinded Town policies 4 and 20 as both are ordinances. Passed 3-0.

               c.  Payroll and Warrant Totals: Warrant last week - $538,292, Warrant this week $47,667; Payroll last week $32,835; Payroll this week $20,225.

               d.  Purchase Orders:

  • #4291 to All States Construction for paving of Deerwander Road out of TIF acct not to exceed $213,465.50
  • #4290 to All States Construction for paving of Sarah Vaughn Road, Eagle Ridge; Nichols Lane up to dirt; West Old Alfred Road; Road and paved area off Moderation Street going into CMP under highway not to exceed $141,125.35
  • #4278 for RMDL to install and replace street signs as needed under highway acct not to exceed $4,500
  • #4279 to White Signs for signs as needed under highway acct not to exceed $4,500
  • #4280 to RMDL for 80 hours grading dirt roads @ 140 per hour under highway not to exceed $11,200
  • #4281 to RMDL for hauling materials for dirt roads, shouldering, washouts as needed from Dearborn Construction under highway acct not to exceed $4,500
  • #4282 to Dearborn Construction for materials for dirt roads, shoudering, washouts, 400 yards @ $25 per yard under highway acct not to exceed $10,000
  • #4283 to RMDL for 5 days labor and equipment to cut brush on town roads as needed and chipper rental from Windham Rental under highway acct not to exceed $9,800
  • #4284 to RMDL for Emergency/Misc work as needed from storm damage, CTC, washouts, under highway acct not to exceed $5,000
  • #4285 to RMDL for Patching Town roads as needed under highway acct not to exceed $4,000
  • #4287 to RMDL for cutting brush, cleaning ditches for 3 days in preparation of Sarah Vaughn Rd paving $3,000 per day under highway acct not to exceed $9,000
  • #4288 to RMDL for cutting brush, cleaning ditches for 3 days in preparation of East Old Alfred Rd and Nichols Ln paving $3,000 per day under highway acct not to exceed $9,000
  • #4289 to Mainly Pavement Management to crack seal Haley Road, Shaw Ln, Mansion Rd, Whitehouse Rd, Pleasant Hill Rd @3.25 per lb under highway acct not to exceed $30,000.
  • #4292 to RMDL for mowing road shoulders for 80 hrs @ $90 per hour under highway acct not to exceed $7,200
  • #4261 to Scarborough Dept Public Works for ongoing vehicle maintenance and repairs under FD acct not to exceed $10,000
  • #4262 to HSE for purchase of new hose - vendor chosen through competitive bid process under FD not to exceed $10,000

               e. Correspondence:

  • Volunteers are needed for the Hollis Community Day event for August 5th, 2023. If you are interested please contact Rec Director Debbie Tefft at 929-5142.
  • Reminder that there will be a guided nature walk at Indian Cellar Preserve led by naturists Joanne & Ruth on Saturday, July 22nd starting at 10AM. Please wear waterproof boots as it may be muddy.
